Hi,
I work as a full time employee (h1b) for a company abc in CA. In Oct 09 they laid off a couple of people and the attorney instead of revoking a laid off persons h1b sent a note to USCIS to revoke my h1b while im still employed. They informed USCIS to ignore the note they sent but USCIS ignored and cancelled my H1. In the meantime attorney files another h1b and got h1b approval (without i94 stub)
I was getting paystub till now and today they called me and said I was out of status due to the mistake they did. They didn't inform me about the out of status from Nov 07 2009. They basically wanted to cover their mistakes. Now yhey are asking me to go to Canada or Mexico to get H1B stamped. Here are my concerns
1) What will be implication in the embassy for such situations where I'm totally unaware of our of status situation
2) Is there chances of my H1B getting rejected in Canada or mexico due to out of status and would they ask me to go to India from Canada/Mexico ( i don't mind going to india but I have 5 month old baby and woudn't want to risk the travel from US to Canada/mexico to India)
3) Or is it advisable to go to india and get it stamped
My company has given a letter stating that it was their error to USICS and agreed to bear all the expenses for travel.
I need your urgent help and all of your comments and suggestions are greatly appreciated.

Usually, USCIS comes close to a grinding halt during the holiday season. People who see some progress in their applications during this period should consider themselves lucky. I would say people shouldn't bother too much until beginning of next year and should enjoy the holidays without any undue stress or tension.

How long did it take for you after filing the FOIA to get the concerned documents ?
Complex tracks(track 2) taking 2-3 months these days, like the one I requested for the complete set of documents in file of my I-485. They send me the CD with all the documents in PDF format.
But if you are looking for specific document I guess it will be faster as they put in simple track(track 1).

Thanks a lot. This is more in depth and I am not understood how these things work.
So if I have MS+ 0 then I think I have to post my ad for JobZone 5. In that case, my SVP will be 7 because MS = 4 yrs and 0 expr = nothing. So i will not exceed SVP 7.
So is the combination,
JobZone 5 with an SVP 7 will work for MS+0.
Also for a software developer or related work, i don't see JobZone5. What kind of positions suit for JobZone 5 in software developers world ?
Anybody know about these things ? please drop in your thoughts

Thanks shar533 for the response. I want to travel by road though and I do have a valid visa.
I just need to get a new I-94 that matches the date on my I-797. I did try local CBP office and they were not willing to change it. They wanted me to apply for I-539 to extend status. So I thought its easier and faster probably to cross the border and get a new I-94.
My question is, If I travel to Canada on my current H1-B to renew my I-94, does it invalidate my pending AP application. Anyone?

Your pending AP does not get invalidated (or even come into picture) as you have a valid stamped visa (I am assuming) and your I-94 will be stamped as "Admitted" rather than "Paroled".
It is the Green card application that is considered "abandoned" if you travel without a valid AP, IF you DON'T have a valid dual intent visa. This situation does not apply to you right now.

This one was really difficult for me to evaluate because of all the openess, but I felt myself gravitating more towards the forms in number 3. Since it was the form that attracted me, I downloaded and cropped to make the fence the focus (since that's what grabbed my attention initially). I think I like the crop sans sky where only the wheatfield ( or is it oats?) and fence posts show the most. I know it has less complexity than the entire photo; maybe I'm just into simplistic and minimalist this week :)

Hi John, I don't consider myself a pro but I'll be more than happy to offer an opinion. I have the exact same set up as you - D70, SB600 speedlight, ect... The best way to get useable rodeo shots with our set up is to shoot rodeos held during daylight. I didn't mean that to sound like a smart ass remark, it's just you have three things working against you during night rodeo photography, the lack of light, the distance and freezing the action. I shot a rodeo that started out with daylight and went into the night. During the daylight hours I was using a 70-300mm zoom with a 2X extender, as it got darker I took the extender off and found a spot closer to the action. I also put my ISO at 1600 and put my SB600 on. If I remember right I was probably around 1/60 or 1/80 and was using the flash to stop the action and to my knowledge there isn't anyway of getting around the animal-flash-eye's syndrome. I just used photoshop to fix it during the post processing. But needless to say the ratio of useable photos during the night portion of the rodeo went way down. Even though I moved as close as possible (right up against the fence 90% from where the bulls were coming out) I had new problems to contend with, for one the dust kicked into the air would work against the flash and wash out the shot. So in that instance you have to rely on luck and timing. So I'd say move around and find your best vantage point and if you have photoshop learn how to use the "curves" function (clicking the white eyedropper on whats supposed to be white in your photo and black on whats supposed to be black). Probably not the solution you were looking for but a few ideas. The bigger fix would to get a camera that has 3200 ISO capabilities. I know there are a few Canon rodeo shooters here that can inform you about that here. Below are a couple links to a couple of my night shots. Good luck.

I don't think you really need the physical card. Canadian Immigration officer simply told me that i am a landed immigrant now, the entry stamp and document attached to the passport are enough for me to come and go freely as long as i live in CA for 2 in every 5 years. So there is no additional advantage from giving an temporary address and getting a card.

They will not let you board the plane otherwise. You will either need the PR card or the entry permit. Check the CIC web site for more info on this. What you say used to be true prior to 2002 before they introduced the new PR card but its different now.

A friend of mine has got 221G from the New Delhi consulate. He works directly for the company there is no client involved here. The consulate has requested the details of every single employee of the company along with their immigration status. My friend is trying to get that information from the employer.

He does not have the stamp in his passport for the new employer. If he has already quit his old employer for which he has the H1B stamp, then he probably must have a new stamp(for latest H1) for re-entering.
First of all, he would be using his new I-94 that is attached to the new H1 he just got from his new employer. So his departure record would show him working for new employer. When he comes back, if he doesnt have visa stamp for the new employer, then it would be a problem, I am pretty sure.
Better check with a lawyer newh1user. I am pretty sure you will need new H1 stamp that is tied to new I-797 if you exit USA and give your latest I-94 when leaving.
Also, think about getting an H1 stamp overseas in Europe while you are at this situation. If you have a bachelors or masters degree from United States, then getting H1 stamping in countries other than your home country is not a big challenge.

If I read your profile right, you arrived in US in April 2005 flied for LC in July 07. I think that is a different situation than someone working in H1B since 1999 (F1 since 1996). Do you know anyone in H1B since 1999 and without an EAD option? I suppose waiting 14 years is very different than waiting 5 years..
Yes, it is different and its unfortunate in your case. However, there is nothing you can do other than wait for your date to be current in order for you to apply for I-485 and EAD/AP.
