I mean stay on L1A (7 Year) with existing company. Apply green card through company B OR any other (For applying grren card, you don't need to be employee of that firm). Switch job as soon as you get I140 (premium process) approved from B company. If everything goes well, One year is enough to get I140 approval through premium process.

I received my daughter's and my I-797A approval notice. All information on the attached I-94s are correct, but we have same I-94# which is my daughter's old I-94#. I called USCIS 800 number. The lady who answered the phone told me that it's normal becauce my daughter is my dependent. I also went to local USCIS office. Basically they don't kown why it happened and how it happened. They say that I should send the I-797As back to the office where the approval notices are issued to see if it's an error.
Any one has this experience? Is there any problem that I use this I-94 number to file I-485 for my daughter and me which USCIS 800 says "no problem."?

I am planning to go to Canada for H1B visa stamping. Will there be any problem if i have company on H1B. I opened in 2003 and My friend is working in that company. I am working for my employer only. Will there be any problem if i have company either in GC stage or getting Visa in Canada.

I have my I 140 approved in 2006 and it has priority date. Filed my I 485 in August 2007. The priority date in the receipt is blank, guess looks to be normal.

Hello,
My H1B was approved 3 weeks back i.e on July 1st and also received approval notice from USCIS on July 5th in USPS mail
But today I have received the status change from Approved to Document mailed from USCIS online system

The USCIS system if often messed up, as long as you have received your approval you are good to work on H-1. In rare cases they may decide to send an notice to revoke after they approve the case since they have overlooked something. I would not worry until i actually get such a notice, also you can have your employer call national customer service to make sure everything is okay with your approval.

I went for H1B stamping, but i know a friend of mine went for F1 (PhD) extension and had to go through the same process. I called Dept. of State multiple times, dont expect a polite response. They may even say it may take years. Thats what they told me the day before i got the visa. Dont worry your wife will get the visa eventually. Tell her to enjoy India in the mean time like i did on my forced vacation.

Starting April 1st, only two Service Center are responsible for all the I-140's, Nebraska & Texas. All I-140's are filed with Nebraska Service Center. Nebraska keeps some of the petitoins and transfers the others to Texas. The ones that NSC keeps has a receipt number starting with LIN whereas the ones that are transfered to TX has the receipt number starting with SRC. So even though the petition might be filed with NSC, chances are it might be approved sonner if it goes to TXSC. Nebraska is taking 4-5 months to approve a petition whereas TX approves it in 15-25 days.

Does anyone have any names and suggestions on the best lawyers in the US? Dan19, could you please tell me which lawyer the person consulted with who got his LC approved? I have contacted Carl Shusterman and have a phone appointment with him on Monday. The letter I got from the labor department is a letter with intent to deny application which means my LC is not denied yet but that they are considering of denying it if I couldn't provide evidence to explain why the job description is restrictive. On the letter however, I am not given the option to readvertise. So my lawyer plans to request for that but he said most likely the Labor department will not grant the consent for me to readvertise

I filed my EB3 I-140 to TSC in June 2006 and it is still pending (yes..really more than 450 days and counting...) Then in July 2007, I filed my AOS with NSC. Today, I got an email from CRIS stating that

I have ben working with employer A on an H1B ( even labor and I-140 approved, PD-April2009) and planning to apply for H1 transfer now through employer B.
After the transfer is approved for B, if I change my mind and decide to continue to work with curent employer A, can I do that ?

Is it true that my spouse (currently on H4) with pending AOS if outside US when my (principal applicant) approval comes, will not be able to use H4. Will her H4 get invalidated the moment i become a permanent resident. What happens if she boards a plane and reaches US to find that her H4 is not valid ?

Any legitimate company should be able to port the PD from an approved I-140 as long as it is allowed.
The plan is to continue working for my current company. I want to use some consulting firm, to file my labor and the whole 9 yards using my current priority date. I dont want to join them. I dont think they will do it for free, if I dont plan on working for them?
