Hello,
My 6 years on H1B is going to expire in Oct 10. I want to file for extension but the lawyer says that i can do it only after Mar 10 that is 6 months before h1b expires.
I have to visit my home country in May 10 and i wanted to go with my new h1b documents.
Can you please suggest if i can file now or is there really a timeframe before we file?
Sorry forgot to mention, I have approved I140.
Thanks for your time and suggestion!

As we all know, the entire north Karnataka and parts of coastal and Malnad regions are in the grip of one of the worst natural disasters the State has witnessed in a long time.
The floods that followed torrential rains have brought unprecedented misery to lakhs of people in the form of destruction to housing, properties, crop loss and deaths.
The State has suffered huge losses with massive infrsatructure damage.Rescue, relief and rehabilitation operations for the affected people are a gigantic task and it will take weeks, if not months. In this hour of human tragedy, we can do our bit to support hapless people as governments efforts alone are not adequate.
People are suffering with no food, no power, no drinking water and no basic amenities. Your generous donations would be utilized to safeguard lives, put their lives back together and provide rehabilitation.

Instead of pay increase, I decided to buy stock in the company I work for (small startup firm) and I work using my EAD, AC21
My compensation and with some profit sharing makes me a 6-7% owner of the firm on paper.
Now, if the company gets hit by a lawsuit and dragged to court, will I be affected?
(My role is strictly IT related and also assist in Data Analytics).
My immigration lawyer is yet to respond.

I am in the same boat.
Approved I-140 in EB3 category. Current employer wants to file in EB2 category, they gave me a new job that qualifies for the category but my Attorney says that I have to withdraw my current EB3 application..
I have read so many post here and every where that tells me that it is possible to continue the process but my lawyer says that I need to withdraw EB3 case.... Any one knows good lawyer around DC Metro area with good experience for Eb3 to Eb2 transfer with the same employer

Since your Father in law is a Central Govt Employee, i believe the reason they issued a white 221g is because he may not have provided a NOC (No objection Certificate) from the govt which should state that he is just travelling to US for tourism purposes and not for job related travel. This was how i had to get my father in law to get a NOC inorder to get his stamping done. Once they saw the NOC, they granted the visa.
My 2 cents.
He had the NOC with him and he did mention it to the Visa Officer about the NOC and she mentioned its not required and asked him to email his CV to the email address listed in the white slip for further processing.

If you ask them to expedite then you are talking to a wall..which means that is next to impossible. I requested them to expedite my EAD renewal twice and they refused to do so (email reply). My case is 78 days old now and the current EAD is expiring in a month from now.

Dear all:
May I ask what I should do in the following situation?
I hold F1 visa and my new job starts on Sept 1. The int'l student office of my current university mistakenly set my OPT start date on May 6. My OPT has been approved and EAD card arrived.
That is, I will have 120-plus "unemployment" days accumulated by early August, which will then violate the "90-day unemployment rule" of OPT.
I am under tremendous pressure and really want to hear your opinions.
Many thanks in advance!

First of all congratulations to all those who got their approval in the last couple months. Now comes the big dilemma for some of us. Did anyone tried to switch their jobs, or at least, ditch their current employer? Did anyone switched their employer immediately after the green card approval? I am sailing in this boat. I want to switch my employer ASAP, but is hesitating to do so... as you know there are some obvious reasons later. What are other problems that you think other than getting tons of questions during the citizenship? Appreciate your answers. ;)
Just my opinion. Stay with employer for 6 months - 1 year. Stay in the same profession for atleast 2 years ( i understood that way from Attorney Ron Gotcher )

We are a few hours away from the biggest Awards ceremony in Hollywood and the world. So what part do Immigrants play in the biggest show on earth? Talent is the one universal passport, and Hollywood has always had a place for immigrants from German maestro Fritz Lang, who headed west when Hitler's minister of propaganda pressured him to take over Germany's top studio, to Polish Roman Polanski, who directed Los Angeles' definitive film noir, "Chinatown," and Taiwan-born Ang Lee, who became the first nonwhite to win an Academy Award for directing for "Brokeback Mountain," his reinvention of the western.
As Hollywood tries to stave off commercial stasis, the industry has been undergoing another chapter in its love affair with foreign writers and directors, particularly those from the Far East and Latin America. The international box office now accounts for more than 60% of a film's box office gross.
Of course, in this age of globalization, it's unclear what it even means to be a Hollywood immigrant anymore. "It doesn't matter where you live," says Paramount Classics chief John Lesher. "We all talk on the phone. We see each other at film festivals. You can edit a movie in Brazil, and your editor can be in London, and you can put it together seamlessly in perfect time."
So for Oscars 2010 we will not able to determine again who is an immigrant and who is not, an honestly who cares. What we want to know is who will win tonight.
For as lacking in suspense as the acting races are, the contest for the biggest prize couldn't be any closer. It's David vs. Goliath here, with 'Hurt Locker' and 'Avatar' seemingly trading "favorite" status every other day.
Unless they somehow split the votes and the Weinstein-backed 'Basterds' revises more history with an upset, the Oscar will go to either the highest-grossing Best Picture winner ever, or the lowest (in half a century, anyway). Be warned: This one is flip-a-coin close. Enjoy the Oscars tonight!!!!

Last December, 2006 I got laid off because of company downsizing. My last pay stub was dated 12/15/2006. My LC was pending more than 365 days in my last company. Recently I got new job offer. My new company attorney is collecting all my immigration related information for filing H1-B extension from me. I have almost 60 days employment gap when my new company attorney file my 8th year H1-B extension.
I like to know the consequence of my 60 days employment gap. Whether my H1-B extension will be denied by USCIS? I will greatly appreciate your valuable suggestions as I am very much worried.

Hello,
I (Indian citizen) am on H1B and wife is on H4 (Canadian citizen). If we plan to get some franchisee and invest money from our savings, will she be eligible for E2 visa and work as an owner?
Thank you!
